New York no-fault coverage claims benefits
If you are injured in a car accident, you are entitled to first-party (no-fault) benefits from the insurer of the vehicle you were traveling in. As the name implies such payments are due and payable without regard to fault for the accident.
New York’s no-fault law entitles individuals injured in motor vehicle accidents up to $50,000 per person per accident for basic economic losses such as medical care and related services, 80 percent of lost earnings during a disability, other reasonable and necessary expenses, and death benefits of $2,000.
You may even be entitled to no-fault benefits if you are injured while getting in or out of an automobile or while removing an item from your vehicle.
A no-fault claim must be filed with the correct insurance carrier within 30 days of the accident. A failure to file a timely notice of a claim precludes any recovery of no-fault benefits. The insurance carrier is under no obligation to let you know you have a claim.
The no-fault law can be difficult to comprehend. Auto accident attorneys at Meggesto, Crossett & Valerino, understand the intricacies of the no-fault law and how to protect your interests. We explain your rights in clear language so you can make appropriate decisions.
If you or a loved one has been injured, even if you don't believe that it is a serious injury, contact Syracuse lawyers at Meggesto, Crossett & Valerino, LLP online or at 315-471-1664 to see what nearly three decades of legal practice can do for you.
